This guide is your go-to for understanding how Deputy has interpreted the [MA000009] Hospitality Industry General Award.
We've built these rules based on the weekly interpretation from Fair Work.

Deputy's pay engine is super helpful, but it's not legal or payroll advice. You're still responsible for paying your staff correctly. Please review our Product Specific Terms for more information about your compliance responsibilities.
Important things to note before using this Award
- These are Deputy's default pay rules. To customise them, use the Pay Rate Builder.
- Averaging of Ordinary hours: Deputy cannot handle averaging ordinary hours over multiple periods.
- Leave Loading: Manually add annual leave loading to timesheets, as Deputy won't include this automatically.
- Higher Duties: This is done through Pay by Area.
- Part Time employees default to 38 hours a week. To customise this, use Regular Working Hours.
- Delayed Meal break - This pay rate will not apply during overtime. If an employee is in overtime and entitled to the delayed meal break penalty you will need to manually adjust their pay to include both.
- Overtime: Deputy considers weekly overtime to be time worked over 38 hours in a single workweek. Deputy does not average hours over a multi-week or multi-roster period. Start of Week is defined by Location Week Start or Agreed Hours Work Period in Deputy settings. Threshold can be modified by Agreed Hours total amount.
- Penalty Rates in Full Hour Increments Only: Deputy does not pro-rate penalty rates for partial hours worked. Penalty rates are applied to timesheets in full hour increments only.
- Loaded Rates: This award permits employers to pay certain employees a loaded rate (a percentage above the ordinary rate) in satisfaction of certain entitlements such as overtime, penalty rates, and some allowances. Deputy does not currently accommodate loaded rates.
- Overnight Stay Penalty Rates: Deputy does not currently automate penalty rates for overnight stays. If your employee(s) stay overnight, please manually apply any overnight stay penalty rates to your employee's pay.
-
Time and attendance only customers: Please note that if you do not use Deputy for rostering purposes, this award will not function properly. Specifically, this award contains pay rates for working on a rostered day off. If an employee logs time in Deputy on a day they were not rostered, this pay rate will be reported on the employee's timesheet as working on a rostered day off, which may incur premium pay or a minimum shift payment. We encourage customers who intend to use this award to upgrade to Deputy Premium which includes employee rostering. If you have any questions, do not hesitate to reach out to support@deputy.com.
