Description
The Nevada rolling overtime pay rule triggers triggers for all time worked beyond a certain number of hours in a rolling 24-hour period.
This pay rule calculation is not available outside of Nevada-based labour laws in USA.
IMPORTANT: Deputy requires the business recalculation setting to be turned on for this calculation type to work correctly. Please read Recalculating approved timesheets.
Example use cases
Rolling Overtime is aimed at supporting Nevada overtime laws. In these laws, an employee cannot work more than a certain number of hours in a rolling 24-hour period.
The rolling 24-hour period is first established on first clock in, and remains that 24 hour period until the employee clocks in for a shift after that 24 hour period ends.
Example 1:
In this example the threshold for overtime is 8 hours in the 24 hour period.
Employee works 10am - 6pm - the rolling 24 hour period is established as 10am-10am.
Deputy will pay this shift as 8 hours without overtime.
If the employee then works 6am -2pm, the first 4 hours are overtime, whereas the last 4 hour is ordinary as the period resets at 10am.
Example 2:
The rolling 24-hour workday stays the same (10am-10am) UNTIL the employee clocks in
for a shift outside that period.
Day 1: 10am-6pm (rolling 24-hour workday is established starting at 10 am; this shift is 8 hours ordinary time).
Day 2: 6am-2pm (first 4 hours is daily overtime because it is included in 24 hour workday that started at 10am on day 1; last 4 hours is straight time because workday resets at 10am on day 2).
Day 3: 9am-5pm (first hour is daily overtime because it is included in rolling 24-hour period that started at 10 am on day 2; last 7 hours is ordinary time because workday resets at 10am day 3).
Day 4: 12pm-8pm (NEW 24-hour workday is established starting at noon because employee clocked in AFTER the end of the previous rolling 24 hour period. This shift is 8 hours of ordinary time).
Day 5: 10am-6pm (First 2 hours are daily overtime because they are part of 24-hour workday that started at noon on day 4; last 6 hours are ordinary time because workday resets at noon today).
Supported rule types
This rule is only available as a base rate. Each minute of a timesheet is assigned a base rate to fill it, depending on whether it meets the rules criteria and the priority of these rules.
Outputs
Returns the amount of hours/units worked after reaching the threshold.

The anchor date when the first overtime period begins. This pay rule will not trigger before this date. Deputy recommends setting a date in a past pay period. |
Days of the week this calculation applies |
Defines which days of the week this rule applies to. For example, if Saturday and Sunday are selected, only parts of the timesheet overlapping Saturday and Sunday are calculated with this rule. |
Time of the day this calculation applies |
Defines which part of the day this rule is applicable to. By default this is all day. However, it can be used to define a portion of a day (eg. a defined night shift, such as 6pm-6am). If this is done, only those parts of the timesheet overlapping this are calculated. |

Defines how the pay rule interacts with scheduled and unscheduled shifts:

Pay portion rule |
Generally, an hourly rate will be assigned according to the exact hours that are matched, however, it is possible to enforce an hourly rate for a full shift even if it only matches a minor or major portion of that shift. Deputy recommends using the Exact Hours option in most cases. |
Rate type |
Categorises the pay rule as Overtime, Ordinary, Penalty or Non-Payable time. These are used to define time worked for other calculation types (for example, Periodic Overtime counts Ordinary and some penalty hours towards it). |
Rate tag |
A custom value that can be applied to the timesheets. Deputy recommends only using this if advised by your implementation consultant. |
Areas |
Will only apply this rule to areas selected in the drop down. By default, all areas are selected. |
Clock in and out requirements |
For this rule to apply, the team member must clock in and clock out within the defined periods. By default this is midnight to midnight (ie. any time is allowed.) |
Custom Timesheet Fields |
