Background
For businesses in Fair Workweek locations, scheduling managers can initiate changes in the schedule that require team members' consent and may incur pay premiums. This is managed in Deputy by:
- the manager publishing a shift that requires consent from a team member
- the team member accepting or declining the shift change
However, there may be times when there are last-minute shift changes that are not initiated via the schedule or even may occur once the shift is underway. Deputy can still capture consent for these actions via shift questions and record the responses on the timesheet for the purposes of Deputy calculating Fair Workweek related pay premiums.
Example of capturing consent for last minute changes
1. A team member is called into work at the last minute and starts an unscheduled shift as a Barista in a New York Fast Food Fair Workweek covered location.
2. Before they can clock in they are asked how many hours they consent to work and whether a manager asked them to work this shift or they requested to work. They can leave a comment to indicate the circumstances of the last minute shift request and then tap Start shift.
When the manager reviews and approves the timesheet they can see that the team member consented to work the 5 hours of the unscheduled shift and that the hours were requested by the manager and one unit of predictability pay was added to the 5 ordinary hours captured in the timesheet.
Fair Workweek related shift questions
In the above example, the shift questions appeared at clock in to capture consent from the team member for the unscheduled changes to the shift. Let's look at the conditions required to trigger these questions to appear.
When you add a Fair Workweek pay rate to a team member's profile then the shift questions relevant schedule consent requirements in that Fair Workweek jurisdiction will also automatically be available for each shift they clock into where the team member starts or finishes the shift outside the scheduled times or begins an unscheduled shift.
Depending on the jurisdiction of your Fair Workweek location, team members may be asked to provide attest to the reason for these scenarios:
- clocking into an unscheduled shift
- clocking in early
- clocking out early
- clock in late
- clocking out late
Let's look in greater detail at the shift questions that team members will be presented with, the possible responses and the effect on the pay premiums in the timesheet.
Note: By default, Deputy assumes that the shift changes are not manager changes, and therefore, pay premiums will only be paid if the employee specifies in the shift question response that the manager asked them to clock into the shift at times that vary from what was originally scheduled.

Adding a timesheet retrospectively
When a team member adds a timesheet to capture a shift they did not clock in for, all the same shift questions are also presented (scroll down on the timesheet) to enable consent to be provided and a response to be selected for the reason for the unscheduled shift in the same way as described above.
