Fast Food Industry - New York City - FLSA Compliant

Pay Condition Name  - Multiplier - When applied 

  • Monday - Sunday (All Day), at a multiplier of 1.00, occurs Monday to Sunday/ All Day 
  • FLSA Weekly OT, at a multiplier of 1.5, occurs after 40 hours worked in a week 
  • FWW - NYC - Deleted Shift, at a multiplier of 0, occurs When a shift is deleted and a premium applies. This will apply on the ordinary hours so nothing will be paid other than premium applicable 
  • FWW - NYC - Clopening Shift Worked $100, at a fixed amount of $100, occurs If an employee worked a close shift on one day and an opening shift on the next without an 11hr break between shifts $100 premium applies 
  • FWW - NYC - SC Additional Hours - U7day & A24hrs - $15, at a fixed amount of $15, occurs If a published shift is changed - and republished - and additional hours have been added within 24hrs and 7days before shift start (excluding new employees) a premium of $15 will apply 
  • FWW - NYC SC Additional Hours - U14day & A7days - $10, at a fixed amount of $10, occurs If a published shift is changed - and republished - and additional hours have been added within 7days and 14days before shift start (excluding new employees) a premium of $10 will apply
  • FWW - NYC SC Additional hours - U24hrs - $15, at a fixed amount of $15, occurs If a published shift is changed - and republished - and additional hours have been added within 24hrs before shift start (excluding new employees) a premium of $15 will apply 
  • FWW - NYC SC Less hours - U14day & A7days - $20, at a fixed amount of $20, occurs If a published shift is changed - and republished - and hours have been removed, within 7days and 14days before shift start (excluding new employees) a premium of $20 will apply 
  • FWW - NYC SC Less hours - U24hrs - $75, at a fixed amount of $75, occurs If a published shift is changed - and republished - and hours have been removed, within 24hrs before shift start (excluding new employees) a premium of $75 will apply 
  • FWW - NYC SC Less hours - U7day & A24hrs - $45, at a fixed amount of $45, occurs If a published shift is changed - and republished - and hours have been removed, within 24hrs and 7days before shift start (excluding new employees) a premium of $45 will apply 
  • FWW - NYC SC No Additional Hours - U14day & A7days - $10, at a fixed amount of $10, occurs If a published shift is changed - and republished - and no change to total hours in the shift,, within 7days and 14days before shift start (excluding new employees) a premium of $10 will apply 
  • FWW - NYC SC No Additional hours - U24hrs - $15, at a fixed amount of $15, occurs If a published shift is changed - and republished - and no change to total hours in the shift,, within 24hrs before shift start (excluding new employees) a premium of $15 will apply 
  • FWW - NYC SC No Additional Hours - U7day & A24hrs - $15, at a fixed amount of $15, occurs If a published shift is changed - and republished - and no change to total hours in the shift,, within 24hrs and 7days before shift start (excluding new employees) a premium of $15 will apply 
  • FWW - NYC - Mgmt Requested Delayed Start - $75*, at a fixed amount of $75 , occurs If the total time of shift has a variance of more than 15 mins - due to manager requesting you to start later - this penalty will apply - will need custom timesheet fields added (see things to note below) 
  • FWW - NYC - Mgmt Requested Extension - $15* at a fixed amount of $15, occurs If the total time of shift has a variance of more than 15 mins - due to manager requesting you to extend shift - this penalty will apply - will need custom timesheet fields added (see things to note below) 
  • FWW - NYC - Mgmt Requested Leaving Early - $75*, at a fixed amount of $75, occurs If the total time of shift has a variance of more than 15 mins - due to manager requesting you to finish early - this penalty will apply - will need custom timesheet fields added (see things to note below) 
  • NYC - FFW - Spread of hours >10hrs allowance, at a fixed amount of $13.5, occurs If the employee’s has worked multiple shifts in one day and the total time between start of first shift and end of last shift is greater than 10hrs apply 1hr of minimum wage

Fast Food Industry - Outside New York City - FLSA Compliant

Pay Condition Name - Multiplier - When applied 

  • FLSA Daily Rate 1 M-Sun All Day FLSA Weekly OT, at a multiplier of 1.5, occurs after 40 hours worked in a week 
  • FWW - NYC - Deleted Shift, at a multiplier of 0, occurs When a shift is deleted and a premium applies this will apply on the ordinary hours so nothing will be paid other than premium applicable 
  • FWW - NYC - Clopening Shift Worked $100, at a fixed amount of $100, occurs If an employee worked a close shift on one day and an opening shift on the next without an 11hr break between shifts $100 premium applies

Conditions - Why 

  • Change of shift premiums - multiple - If a published shift is changed and republished multiple times, multiple of the same or different premiums will apply 
  • Custom Timesheet fields - adding these to account - Please email experience@deputy.com to have these added into your Deputy instance. In addition, you will need to provide the language you wish to apply for each custom timesheet fieldE.g. “You have finished your shift more than 15mins after scheduled end time, was this manager requested” A: Yes or No 
  • Changing Pay Condition Export Codes from default - Currently the export codes on the pay conditions above are set to be default for all accounts, to change this for your payroll system use the below instructions.Approve all timesheets → Go to Timesheets - Export Timesheets → Select all to select all employees → Group by Pay Rate → Edit Export Codes to match your payroll system
